What are the UK ad disclosure rules for creators?

If you’re paid, gifted or otherwise rewarded for a post, UK rules expect your audience to know. This is a plain summary of what the advertising watchdogs ask for. It’s general information, not legal advice.

The two watchdogs to know

In Britain the ad side of social media sits with the ASA, which applies the CAP Code to marketing of all kinds, influencer content included. Separately, the CMA uses consumer law to go after disguised promotion and anything that misleads shoppers. Each has put out plain-English advice aimed at creators.

Spotting when your post is advertising

In rough terms you’re advertising when a brand has paid you or given you something (money, free products, commission or perks) and has some control over the content, or when it’s an affiliate link. If the brand approved the caption or asked for the post, treat it as an ad.

How to label it so people notice

  • Lead the caption with #ad (or the word “Ad”) so it shows before anyone taps more.
  • Use Instagram’s paid partnership label as well, not instead of #ad.
  • On Stories and Reels, show the label on screen, on every frame where the product appears.
  • Skip fuzzy shorthand such as #sp, #spon or a vague “shout-out”.

Gifts, freebies and affiliate links

A gifted product with no strings attached may just need a clear “gifted” mention under CMA guidance. If the brand asked for a post in return or controls it, it becomes an ad and needs #ad. Affiliate links earn you money per sale, so label those posts as ads too.

Your own products count as well

Promoting your own shop, course or service is advertising too. It should be obvious from context that it’s yours; if it isn’t, say so plainly.

Honest numbers when pitching brands

Brands set fees partly on audience size. Presenting inflated follower counts as genuine reach when negotiating could be seen as misleading. If you’ve ever bought followers, pitch on engagement and Insights screenshots instead. Our sponsored post calculator estimates a fair rate from engagement, and the engagement checker gives you the rate to quote.

When a creator forgets the label

The ASA can publish a ruling naming the creator and brand, ask platforms to remove content and list repeat offenders publicly. The CMA has powers under consumer law and has pursued influencers and brands before. A clear #ad costs nothing by comparison.

A quick checklist before posting

  1. Was anything given or paid?

If yes, you probably need a label.

  2. Is #ad up front?

Visible before “more” on the caption.

  3. Is the partnership tool on?

    Add it alongside the label.

  4. Are claims honest?

No before-and-after edits or promises you can’t back up.

Where to read the official guidance

The ASA and CAP publish an influencer guide to making ads clear, and the CMA has its own advice for social media endorsements; both are free on their websites and worth bookmarking. They get updated, so check them before a big campaign rather than relying on memory or on what other creators do. If a brand contract asks you to drop the label or bury it, push back: the responsibility is shared, and your name is the one on the post. For bigger deals, a short chat with a solicitor who handles media work is money well spent. And keep an eye on your own numbers, using the engagement checker before you quote rates.

#ad questions from UK creators

Do I need #ad on a gifted post?

If the brand asked for the post or controls it, yes. If it was a no-strings gift, a clear “gifted” mention is the minimum.

Is the paid partnership label enough?

UK guidance suggests also using #ad clearly, as the label alone can be missed.

Do small accounts have to follow the rules?

Yes. The rules apply whatever your follower count.

Can buying followers break advertising rules?

Buying itself isn’t covered, but using inflated numbers to mislead advertisers can be a problem.
